上海交通大学 MPA 学位论文 常州市城市管理行政执法的现状及对策研究 IV常州市城市管理行政执法的现状及对策研究 摘 要 城市管理执法的实施，对解决城市管理中存在的职责交叉、多头执法、重复执法、 执法扰民、 效率低下和执法机构膨胀等问题， 对进一步全面推进依法行政，加快法治政府建设，起到了十分重要的推动作用。但是城市管理行政执法也还存在不少问题。近年来，城市管理行政执法人员与小商贩的矛盾日益激化，暴力执法与暴力抗法屡见不鲜，引起了人们的广泛关注。如何改变城市管理行政执法现状、提高执法效能成为当今时代城市管理的重要课题。 本文以常州市为例，对城市管理行政执法的理论和现实问题进行了分析。全文共分六个部分：第一章为绪论，介绍全文的研究意义、研究现状和研究内容。第二章为城市管理行政执法相关的理论分析，介绍了城市管理行政执法的内涵、性质、功能、原则，以及展开研究的理论依据。第三章为常州市城市管理行政执法的问题及成因分析。介绍了常州市城市管理行政执法的概况，分析了城市管理行政执法中存在的主要问题，例如：城市管理行政执法法律体系不健全、城市管理行政执法理念落后、城市管理执法的程序使用欠规范、粗暴执法和暴力抗法的现实困境、城市管理行政执法体制还不健全、城市管理行政执法的监督机制不健全等。并且从管理体制、执法依据、执法监督、执法观念、执法环节等方面分析了造成现存问题的原因。第四章介绍了国内外其他城市管理行政执法的成功经验。第五章提出了加强常州市城市管理行政执法的对策建议，例如：更新城市管理行政执法观念、推进城市管理行政执法体制改革、健全城市管理行政执法的监督机制、加强城市管理行政执法队伍建设等等。 关键词：行政执法 城市管理 常州 对策 上海交通大学 MPA 学位论文 常州市城市管理行政执法的现状及对策研究 VRESEARCH ON STATUS AND IMPROVEMENT MEASURES OF ADMINISTRATIVE EXECUTION OF CITY MANAGEMENT IN CHANGZHOU ABSTRACT The system of the enforcement of law in city management, as an effective way of dealing with the malpractice in Administrative-Law-Enforcing System, have got many achievements, such as reducing team quantity, enhancing the efficiency, promoting reform of Administrative-Law-Enforcing System and so on.
