为了适应公司新战略的发展，保障停车场安保新项目的正常、顺利开展，特制定安保从业人员的业务技能及个人素质的培训计划修改后的合同,英文中德高铁合作项目工程施工合同Contract发包方：PartyA:德意志联邦共和国德中高铁合作项目招标委员会承包方：PartyB:中国海外工程有限责任公司中德高铁合作项目根据中华人民共和国宪法德意志联邦共和国宪法以及其他有关法律法规规定的原则，结合本工程的具体情况，甲、乙双方在平等、自愿、协商一致的基础上达成如下协议，共同遵守Accordingtoaswellasotherlawsandregulationsrelevanttothespecificcircumstancesofthisproject,partiesAandBhaveherebyequallyandvoluntarilyenteredintothefollowingagreementexecutedonthebasisofmutualrespect.一、概况OVERVIEW1.甲方由德意志联邦共和国议会授权PartyAistheowneroftheproperty.2.乙方为由中国海外工程有限责任公司授权PartyBisapprovedandregisteredwiththecityindustrialandcommercialadministrativeorgansasanenterpriseengagedinrenovationanddecoration.3.施工地点：从法兰克福至富尔达Constructionsite:4.施工内容：包括站点建设、电器控制、铁轨铺设、附属设施及防护系统的建设详见附件一站点建设建筑面积平方米，施工面积平方米。电器控制建筑面积平方米，施工面积平方米。铁轨铺设建筑面积平方米，施工面积平方米。附属设施及防护系统的建设建筑面积平方米，施工面积平方米。22Constructionarea:totalarea(includingstairwellsandothercommonareas):m,privatelivingarea:m.5.总价款：.00元，大写(人民币):元整。Totalprice:.00RMB;inwords:元整.Anychangesinthispricemustbeagreedbybothpartiesinwriting.6.工期:自XX年月日开工，至年月日前竣工,工时总计天，不含国家法定节假日,乙方委派现场施工监理为侯文凤女士，联系方式:zdgthzxmgczjPeriod:Start:(year)(month)(day);Completionbefore:(year)(month)(day);Totaldays(excludingnationalholidays):days.PartyBsonsiteconstructionsupervisorwillbe:二、关于工程付款及结算的约定TERMSOFPAYMENT1.工程款的付款方式如下1三、关于材料供应的约定AGREEMENTONTHESUPPLYOFMATERIALS1.乙方提供的材料：乙方供应的材料、设备,如不符合设计、施工要求，应禁止使用。如已使用，对工程造成的损失由乙方负责。如甲方要另增加材料由甲方供应，并应符合下列规定：MaterialprovidedbyPartyB:AnymaterialsorequipmentsuppliedbyPartyBwhichdonotmeetthedesignandconstructionrequirementsareprohibited.AnyextramaterialsrequestedbyPartyAwhichwerenotintheoriginaldesignmustbepaidforbyPartyA.2.甲方提供的材料：另拟补充附件甲方负责采购供应的材料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙方负责保管MaterialprovidedbyPartyA:(seetheannex:“TableofMaterialstobeprovidedbytheOwner”).IfPartyAacquiresmaterialsfortheproject,itshouldfirstcheckwithPartyBthatthematerialsmatchtothedesignrequirements,andoncethematerialsareinthecareofPartyB,thenPartyBisresponsibleforthematerials.IfPartyArequiressomematerialswhichdonotfittothedesignthenitshallbetheresponsibilityofPartyAtopayanyadditionalcostsincurredbyPartyB.四、关于工程质量及验收的约定FULFILMENTOFTHISAGREEMENT1.本工程应符合质量评定验收标准Theexecutionofthisprojectmustbeconsistentwiththe“ArchitecturalandEngineeringRules”ofthecityadministrativedepartmentsresponsibleforthedevelopmentofbuildingsandlocalstandardsandqualityevaluationacceptancecriteria.2.本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认PartyBmustprovideaduplicatecopyoftheconstructiondesignsanddrawings,andbothcopiesshouldbesignedbybothparties.3.甲方提供的材料、设备质量不合格而影响工程质量，其返工费用由甲方承担，工期相应顺延IfmaterialsprovidedbyPartyAfortheconstructiondonotmeetthenecessaryrequirements,PartyAshallbearresponsibilityforanyresultingdelaysinthecompletioninthe由于乙方原因造成质量事故，其返工费用由乙方承担IfthequalityofPartyBsworkresultsinanyaccidents,theliabilityforsuchaccidentsshallbetheresponsibilityofPartyB.5.在施工过程中，甲方提出设计修改意见及增减工程项目，须提前与乙方联系，在双方签订后，方能进行该项目的施工、因此影响工程竣工日期的，责任由甲方承担。凡甲方私自与施工人员商定更改施工内容、增加施工项目所引起的一切后果，甲方自负，给乙方造成损失的，甲方应予赔偿If,duringtheconstruction,PartyAwishestoproposeachangetothedesign,heshouldsigna“ChangeofProject”withPartyBandmustassumeresponsibilityforresultingdelaysorincreaseincosts.IfPartyAsecretlyattemptstochangetodesigndirectlywiththeconstructionpersonnelandthisactioncauseslosstoPartyB,thenPartyAmustcompensatePartyBforthisloss.6.工程验收：乙方负责理隐蔽工程和中间工程的检查与验收手续。由乙方组织专门人员进行验收。一切理隐蔽工程和中间工程的质量由乙方负责Thestandardofwork.ItistheresponsibilityofPartyBtomakesurethatallconstructionworksarecarriedouttotherequirementsofthedesignandtomakesurethatallinternalwallsandhiddenconstructionpartsaretotherequiredstandard.7.工程竣工：乙方完工后即应通知甲方验收，甲方应在竣工当日组织验收，并办理验收移交手续，双方签。如果甲方在规定时间内不能组织验收，须及时通知乙方，另定验收日期。如通过竣工验收，甲方应承认原竣工日期，并承担因此造成的乙方的看管费用和其他相关费用Projectcompletion.PartyBmustnotifyPartyAwhentheprojectiscompleteandreadyforinspectionbyPartyA.Afterinspectionbothpartiesmustsignan“EngineeringQualityAcceptance”document.IfPartyAisnotavailabletoinspecttheconstructionsiteonthecompletiondate,hemustnotifyPartyBofthesoonestavailabledate.WherePartyAisnotavailableonthecompletiondatetoretakecustodyofthelocation,hemustpayanyextracostsincurredbyPartyB.8.工程保修期五年。工程竣工验收后甲、乙双方签署，凭保修单实行保修，保修期五年，从竣工验收签章之日起算Oneyearwarranty.Aftercompletionoftheworkandsigningofthe“SingleWarranty”,thereshallbeaoneyearwarrantyontheconstruction.五、有关安全生产和防火的约定SAFEPRODUCTIONANDFIREREGULATIONS1.施工图纸和施工说明应符合防火防事故的要求，主要包括电气线路等管道畅通、合格。乙方在施工中应采取必要的安全防护和消防措施，保障作业人员及相邻关系的安全,防止相邻单位的管道堵塞、渗漏水、停电、物品毁坏等事故发生Constructiondrawingsandconstructionmustbeinlinewithfirepreventionregulations,andaccidentprevention2requirements.Thisincludeselectricalcircuitsandpipelines.PartyBshalltakemeasurestoensurethesafetyofworkersandneighborsattheconstructionssiteandmustpreventleakageofwater,interruptionsofpoweranddamagetoproperty.
