有关聘请合同(中英版)CONTRACTTheengagingparty:TheInstituteof，ChineseAcademyofSciencesTheengagedparty:Dr.1.TheInstituteof_，ChineseAcademyofSciences，(HereinafterreferredtoasPartyA)wishestoengagetheserviceofDr._(HereinafterreferredasPartyB)asaVisitingScholarforoneyear.Thetwoparties，inaspiritoffriendlycooperation，agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.2.Theperiodofservicewillbefrom_to_.3.ThetemporarytitleoftheengagedpartyisVisitingScholar.PartBisrequiredtobedisciplinedtotherelatedregulationofPartAduringthecontractperiod.4.ThedutiesofPartyBare_.(moredetailsrefertotheattachedpages)5.PartBchoosesMr./Ms._ashis/herco-researcher，andisrequiredcarryouttheco-researchactively.6.PartyBsmonthlystipendwillbe￥_yuanRMB.Therewillbeadditional￥_yuanRMBpermonthforaccommodationand￥_yuanRMBpermonthforthemedicalandsocialinsurances.(moredetailsrefertotheattachedpages)7.PartyAsObligationsa)PartyAshallintroducetoPartyBthelaws，decreesandrelevantregulationsenactedbytheChinesegovernment，thePartyAworksystemandregulationsconcerningadministrationofforeignexperts.b)PartyAshallconductdirection，supervisionandevaluationofPartyBswork.c)PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.d)PartyAshallpayPartyBssalaryregularlybythemonth.8.PartyBsObligations:a)PartyBshallobservethelaws，decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChinasinternalaffairs.b)PartyBshallobservePartyAsworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyAsarrangement，direction，supervisionandevaluationinregardtohis/herwork.WithoutPartyAswrittenconsent，PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.c)PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.d)PartyBshallrespectChinasreligiouspolicy，andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.e)PartyBshallobserveChinassecuritystipulationsabouttherelevanttechnologyandresearch，andshallnotconductanyactivitiesincompatiblewiththestatusofanexpert.f)PartyBshallrespecttheChinesepeoplesmoralstandardsandcustoms.9.Therightofproduction，includingthecopyrightofpaper，patentsetc.baseduponthecontractworkbelongstoPartyA.PartyBisentitledtotherewardpolicyorpublicationinplaceatPartyA.Publicationinrefereedjournalsishighlyencouraged.PartBshouldacknowledgetheFellowshipasfollows:supportedbytheCASResearchFellowshipforInternationalYoungResearchers(moredetailsrefertotheattachedagreementontherightofproduction)1.PartyBwillenjoytheofficialholidaysinChinaduringthecontractperiod.Inaddition，PartBwillbeentitledtoholidaysnotexceeding5days，basedonhis/herdomesticcountryscustom.11.Writtenapplicationisprerequisiteforabsencefromduty，forsickabsencetheapplicationshallbepresentedwithprooffromhospital.Paymentduringsicknessabsencewithin1daysisissuedatnormalrate.IfthePartyBisunabletocontinuetheemploymentduetohealthproblem，thecontractcanbeterminatedonbasisofnegotiationonmeritsofeachcase.12.Revision，CancellationandTerminationoftheContract:a)Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising，canceling，orterminatingthecontractwithoutmutualconsent.b)Thecontractcanberevised，canceled，orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement，thecontractshouldbestrictlyobserved.c)PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions:i.PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated，andhasfailedtoamendafterPartyAhaspointeditout.ii.Accordingtothedoctorsdiagnosis，PartyBcannotresumenormalworkafteracontinued3-daysickleave.d)PartyBhastherighttocancelthecontractwithawrittennoticetoPartyAunderthefollowingconditions:i.PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.ii.PartyAhasnotpaidPartyBasscheduled.13.BreachPenalty:Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated，thatis，breaksthecontract，itmustpayabreachpenaltyofUS_(ortheequivalentinRMB￥_).IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol，itshouldproducecertificationsbythedepartmentconcerned，obtainPartyAsconsent，andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason，itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol，withtheconsentofPartyB，itshouldpayPartyBsreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason，itshouldpayPartyBsreturnexpensesandpayabreachpenaltytoPartyB.14.Theappendixesofthiscontract_
